“Clean Water Theme Park” – Parking (site access / entry to the premises)
Hello, I am the Witches’ Cauldron fungus (Sarcosoma globosum). I am one of the most peculiar and rare spring fungi, with barrel-shaped fruiting bodies that are brown and wrinkled. On the upper surface there is a bowl-shaped spore-bearing layer which, when touched, feels like a pouch instantly filled with water.
To visit me and many other plants and animals, please purchase an admission ticket. The proceeds help to protect us and to develop the theme park.

Terms and conditions of the Private Road Use Agreement
Between Metsamõisa Loodus OÜ (hereinafter: the Private Road Operator) and the owner or user of the vehicle (hereinafter: the Driver), a private road use agreement (hereinafter: the Agreement) is concluded under the following terms (hereinafter: the Terms):
The Operator, by presenting the terms set out in the Agreement, makes an offer to conclude the Agreement pursuant to the Estonian Law of Obligations Act (VÕS), § 16(1). By parking a vehicle in the parking area, the Driver accepts the terms presented by the Operator, and the Agreement is deemed concluded pursuant to the Law of Obligations Act (VÕS), § 20(1).
For the purposes of the Estonian Traffic Act (LS), § 2(49), parking is considered the intentional stopping of a vehicle for longer than is necessary for passengers to board or alight, or for loading cargo.
The vehicle owner is jointly and severally liable with the Driver for compliance with the terms of the Agreement. The Operator is entitled to assume that the vehicle owner or responsible user is the Driver and a party to the Agreement.
The Driver is obliged to pay the parking fee for using the Operator’s parking space or to hold a parking permit granting the right to park in the given parking area, regardless of the day of the week or time. The Driver is responsible for ensuring that the parking permit is placed visibly on the vehicle’s dashboard so that it is readable from outside the vehicle for the entire parking period, except where the parking fee has been paid via mobile phone or the vehicle has a valid electronic parking permit. If the parking area allows free parking for a limited time or parking without a permit, the Driver undertakes to record the start time of parking in accordance with the instructions posted in the parking area.
The amount of the parking fee, the conditions for paying the parking fee, and the conditions for using the parking permit are shown on the parking information board and in the webshop www.ubari.ee/pood/.
The Driver must use the parking area and parking space with due care and follow the parking signs, information materials, markings, and the Operator’s instructions.
In the event of a breach of the Agreement, the Driver undertakes to pay the Operator a contractual penalty of 55 euros. Payment of the contractual penalty does not replace the obligation to pay the parking fee. If the breach continues, the Operator has the right, after 24 hours from the previous penalty claim, to submit a new claim.
In the event of a material breach of the Agreement, the Operator has the right to apply all remedies permitted by law, including removal (towing) of the vehicle or exercising a lien to prevent the vehicle from leaving the parking area. Removal may be applied, among other cases, if the Driver repeatedly breaches the Agreement, the vehicle has no licence plate, or the vehicle is parked in a place not designated for parking. In the event of removal, the Operator has the right to retain the vehicle at the removal location until the Operator’s claims have been paid in full, including vehicle removal-related costs in the amount of 500 euros.
The Operator has the right to assign claims arising from the Agreement to a debt collection service provider, to pursue the claim in court, and to disclose debt data (payment default data) to the Operator’s contractual partners.
The Operator is not liable for damage caused to the vehicle during parking or while driving within the parking area by the Driver or third parties.
